What if Scor! Must Cancel an Event?
We have no plans to cancel an event, but just in case...
Scor! does not plan to cancel any event. We will do everything we can to run all in-person events as planned. However, after several seasons were cancelled for pandemic-related reasons, we’ve had to add more policies and procedures in case of future cancellations.
Force Majeure: Scor! shall not be held liable or responsible to the Client nor be deemed to have defaulted under or breached this Agreement for failure or delay in fulfilling or performing any obligation under this Agreement when such failure or delay is caused by or results from causes beyond the reasonable control of Scor!, including but not limited to fire, floods, severe weather, illness, injury, death, embargoes, war, acts of war, energy or fuel shortages, catastrophic monetary or hyper-inflationary crisis, banking or government asset seizure, government actions or orders (such as lockdowns, event or gathering restrictions, social distancing requirements, mask mandates, health orders or restrictions, travel restrictions, wide-spread isolation recommendations or requirements, medical or health testing requirements, vaccine requirements, gene-based therapy requirements, implant requirements, energy-use restrictions, and others resulting from any domestic governments or international governmental bodies), government or treaty-based emergency declarations (such as a real or potential health emergency, climate emergency, energy emergency, food emergency, or any other declared emergency, whether declared by domestic governments or international governmental bodies such as the U.N., W.H.O, and similar), pandemics/epidemics, cyberattacks or internet shutdowns, extended power outages, insurrections, riots, strikes, lockouts or other labor disturbances, acts of God, or any other unforeseen extenuating circumstances; provided, however, that Scor! shall use reasonable commercial efforts to avoid or remove such causes of nonperformance, and shall continue performance hereunder with reasonable dispatch whenever such causes are removed. Scor! shall provide the client with prompt written notice over email of any delay or failure to perform that occurs by reason of force majeure.
Partial Event Cancellation Remedy: If only a part of an event is cancelled due to Force Majeure, then the sole remedy to the client is a 65% credit of total monies paid for said event to be used exclusively for select online programs as defined by Scor! staff, prorated on the number of days cancelled. (For example, 4-day instructional event, 2 days cancelled = total tuition money paid (0% credit for meals) x 50% proration x 65% = amount of credit.) This percentage reduction reflects the loss of unrecoverable venue and administrative costs.
Full Event Cancellation Remedy: If one or a few (at the discretion of Scor!) events are cancelled due to Force Majeure, then the sole remedy to the client is a 65% credit of total tuition paid for said event to be used exclusively for select online programs as defined by Scor! staff. This percentage reduction reflects the loss of unrecoverable venue and administrative costs. Meal fees will be credited when possible for meals not yet ordered by Scor! for the event.
Multiple Event Cancellation Remedy: In case of a Force Majeure event of sufficient size (affecting multiple Scor! events), Scor! will substitute an online instructional sequence of appropriate length & value (to be determined solely at the discretion of Scor! Staff) for the cancelled in-person events as the sole remedy to the Client. (No Scor! account credits will be issued.) The specific length and extent of the substitute online instructional sequence will be structured in order to cover certain fixed and unrecoverable costs that Scor! has already incurred for the event. The substitute online instruction won’t necessarily be an exact duplicate or replacement. It will be equivalized as much as possible given the constraints of Scor! fixed costs and expenses incurred. Scor will in good faith seek to replace the event with said online sequence. In the event that there are mass internet outages or Scor! is unable to access a suitable internet connection, said substitute online experience will be delayed at the discretion of Scor! staff until a time in which it is possible to offer it to the majority of participants. (If any individual clients cannot access the internet or have intermittent internet access, all sessions will be recorded and made available to all participants at any time without any specified end date.)
Event Modification Remedy: In the event of Force Majeure that doesn’t necessarily require cancellation of the event, but requires modifications of the event (such as event structure, location, and cost of components), such changes will be proposed by Scor! staff for possible acceptance by client. If a Scor! event requires modification due to a Force Majeure event, and client declines said modification, client’s sole remedy is a 65% credit of total amount paid for the event to be used in select online programs defined at the sole discretion of Scor!.
Scor! Declared Force Majeure Supercedes Individual Client Cancellation: If client cancels for reason of the same or related force majeure situation, Scor!’s policy of cancellation of an event by declared force majeure will take precedence over the standard client individual cancellation policy. As such, all clients in the relevant event will be considered cancelled due to the invoking of force majeure by Scor!, and subject to its force majeure policy.
The Scor! Cancellation Policy and all other policy pertaining to Scor! are construed under the laws of New York State and Ontario County, the location of Scor! events.
This Cancellation Policy was revised April 23, 2023 & again February 14 2025 and remains in effect for the summer event season and perpetually or until a new revision is made by Scor!.
