Terms & Conditions of Scor! & Symerge Online Programs


 
By checking this box, you (client) agree to the following terms and conditions within which Scor! online programs, materials, access, etc. are being offered.

Here’s a short summary of below terms & conditions. (See below for details.)

 

 

And now for the details…

 

Definitions: (“You” and “yours” refers to you, the Scor! client. “We”, “us”, and “ours” refers to Scor!)

 

Payment Agreement

Scor! does not allow clients to register without payment. Registration is dependent on successful payment, and if payment is not successful, your registration may be revoked.

 

Membership Payments & Cancellation

When clients sign up for an ongoing membership, you understand and give your permission that your card will be charged regularly for each successive month or year after you sign up, depending on the plan you chose. If your card expires or is cancelled, you understand that you have to update your payment information with Symerge, and that if you don’t, your access will be revoked at the end of your term due to non-payment.

 

If a client wants to stop paying, you understand that you need to cancel your membership. (This can be done inside your own dashboard or by request.) Once cancelled, client’s access to the membership benefits will terminate at the end of the specified payment period. (If annual, access is removed at the end of the 1-year period. If monthly, access is removed at the end of the monthly period.) At this point, client will no longer be charged on ongoing fee. You understand that upon cancellation, you will not receive a refund, but all upcoming recurring charges for your membership will be stopped. 

 

Client membership payments purchase access to membership benefits for a specific period of time. Symerge cannot return money to client for access that had been purchased, even if client did not decide to use it. (For example, if an individual purchased a concert ticket or a park pass but decided not to go, there is no refund afterward.) If you are unsatisfied with your memership, Scor! staff will work with individual clients to try to find solutions that provide alternative value for funds paid, if possible, including but not limited to substantial coupons and custom credits for other offerings.

 

Course Payments

Client understands that payment must be complete to have access in and participate in the course. Failure to make a complete payment or complete a payment plan prior to the course opening means client cannot participate in the course until payments have been completed. Client understands that if payments are not completed, you will not have access to the course, you will not be granted any account credit, and any monies paid to Scor! as part of that plan will be forfeited. (If possible, Scor! staff will work with individual clients to try to find solutions that provide alternative value for funds paid, minus a processing fee.)


 
No Refunds

Scor! does not offer refunds for its programs (including cash, check, credit card, Paypal, etc.). Most of the costs involved with creating a Scor! experience are incurred well before the event. As a result, we are unfortunately unable to offer refunds. In addition, if you have a schedule conflict, illness, or other circumstance come up, you may easily watch recorded sessions later and receive an equivalent value for your cost. Finally, Scor! is not responsible for the functionality of your computer, devices, A/V, software, or internet connection.

 

Payment Plans

In selecting a Payment Plan, client grants Scor! permission to charge the credit card used at registration for all required payments up to the total fee. Clients agrees to maintain the credit account used when registering, or inform Scor! of another replacement prior to payment dates. If Scor! is unable to receive timely payment due to client credit account closure, overlimit, or other reason, Scor! reserves the right to charge a late fee of $10 per incident to re-submit the charge (only for payment plans, not for memberships). If successive payments are not successful and client cannot provide alternative payment that is successful, access to Scor! programs will be removed, no account credit will be granted, and any monies paid to Scor! as part of that plan will be forfeited. (If possible, Scor! staff will work with individual clients to try to find solutions that provide alternative value for funds paid, minus a processing fee.)

 

Payment Authorization

If client calls in an electronic check or credit card payment, you agree that you have authorized that payment to be charged to your bank account or credit card in the amount discussed on the phone (generally the remaining balance).
 

Credits

Client understands that if you have a credit from a previously cancelled tour Scor! Camp, you can use that credit only to sign up for an online course or an in-person event. Your credit is a dollar amount, so that will reduce what is owed for online courses and in-person events. However, you cannot use your credit to sign up for a membership. This is due to the ongoing nature of memberships, which are a new and unrelated program to our past offerings of tour Scor! camps. Also, due to the use of new specialized software and an independent accounting system, we are unable to apply past credits to new memberships.

 

Cancellation by Scor!

If a live class is interrupted by a power or internet outage on the side of Scor!, we will attempt to continue when power or internet access returns, and make up missing time at the end of the class. If necessary, the class will be rescheduled with no extra charge to the client. If the client experiences an isolated interruption of power or internet outage, client will not receive credit or compensation from Scor!, but is provided equivalent value by taking advantage of recordings that will be made available of group classes for later viewing.

If, due to an act of God, illness, injury, severe weather, government orders or actions, unforeseen extenuating circumstances, or death, Symerge (a.k.a. Scor!) cancels an online program or portion of an online program, that program or portion will be rescheduled when at all possible. In the unlikely event that it is not possible to reschedule, an account credit for the cancelled portion, not to exceed all monies paid by the client for that event, will be granted as the sole remedy to the client.

Community Social Expectations

We have an expectation that clients will conduct themselves with courteousness and respect. Any hateful, offensive, disrespectful, threatening, or accusatory language, or any communication which disregards and maligns other participants or the role of founders, staff, & faculty (having founded and sacrificed greatly for this organization through the years), may result in the immediate removal of said client from participation in the current programs of Scor! & Symerge, and from future participation or communication concerning program opportunities. Such action may also result in the immediate revoking of any or all credit held by said customer. Such removal or revoking decisions shall be left to the sole discretion of the staff of Symerge.

Any communication within the Scor! community, whether online or in person, needs to be carried out in a courteous, kind, and respectful manner. Any client who, after being warned, still violates these requirements, may be asked to leave or may be removed from said community and communication at the sole discretion of the staff of Symerge.

Any discussions between clients and other participants or faculty/staff that occur through the online programs of Scor! and Symerge must not include hateful, offensive, disrespectful, threatening, or accusatory language. Also, participants need to stick to the topic at hand, such as string playing, and any related topics. Overtly hateful or purposely offensive discussions, seriously aggressive or agenda-driven behavior, seizing of the Scor! platform for personal gain or the forwarding of an alternate agenda, or cruel or damaging off-topic discussions are prohibited. If a violation of this request occurs more than once, clients who perpetrate such discussions may be removed immediately from such communication (including but not limited to the Community Forum, live Zoom classes, and on-lesson discussions) at the sole discretion of the staff of Symerge. 

No Masks on Camera

Client agrees not to wear a mask or facial covering while on camera. Facial coverings impair visual and auditory communication. If you turn on your video camera so that your face and body can be seen for a better instructional experience, we cannot give that to you if your face is obscured, because your face is a very important part of communicating to us what’s going on. If we cannot see your facial expression or hear your voice clearly, we cannot communicate with you effectively. (It is the same as if you are asking about your left hand position, but you put a scarf over your left hand.) Showing your face will allow you to have a genuine learning experience, and allows the instructor to use all available avenues of communication to aid you constructively. (If for some reason you feel you must wear a mask during an online program, please keep your video camera turned off.)

No Customer Service on Community Forum (or other public settings)

Discussion of customer service issues, payment issues, policy issues, questions, grievances, complaints, and other such matters shall be handled privately over email (and phone, when necessary). These communications will not and should not take place in a public forum of any kind, such as in the online Community Forum, a lesson discussion, a live Zoom class, or any social media. If, after being advised and warned, such inappropriate communications are continuously initiated, the client may have public communication privileges (such as access to the Community Forum) revoked at the sole discretion of the Scor! staff. In addition, please note that we are unable to regularly respond to facebook posts, any facebook messaging personally directed to a Scor! staff member will not be viewed nor responded to.

 

‍Don’t Steal our Materials (share them with a non-participating, non-paying individual)

 

Client agrees not to steal Scor! materials, nor share them with a non-participating, non-paying individual. Instead of “sharing” (a.k.a. stealing) our materials from online memberships or courses with your friends & acquaintances, teachers, or fellow musicians online or in person, encourage others to sign up for Scor! programs themselves as paying customers. Only in this way can we work together to ensure a future for programs such as this.

 

Use of Site

Scor! provides various materials, information, videos, quizzes, handouts, questions, articles, and other information (aka “Materials”) on this and related sites and in programs offered through this site. Scor! authorizes each client to view and download one copy of the Materials. Materials may be downloaded and a maximum of one copy of the Materials may be printed provided that client make no modifications to the Materials and you retain all copyright notices and other proprietary notices contained in the original Materials on any copies of the Materials. Users may not modify the Materials at this Site in any way or reproduce, share or distribute them. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. Any breach of these Terms of Use automatically terminates your authorized use of the Site.

 

If you are caught stealing, distributing, selling, or benefitting from the sale of Scor! materials that are copyrighted by Scor!/Symerge or by another author and only available through a paid portal, Scor! reserves the right to charge you commensurate licensing fees for the use of such materials. Scor! also reserves the right to revoke privileges previously granted and even paid for on the site for violation of terms. Such decisions are up to the sole discretion of Scor! staff. 

Trademark and Copyright

The Materials on this Site are copyrighted, and any unauthorized use of any Materials on this Site may violate copyright, trademark, and other laws.

Limitation of Liability

In no event will Scor! or Symerge, its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever (including, without limitation, those resulting from lack of educational progress, interruption of services, interruption of internet or inaccessibility to internet, breakage of computers, phones, or tablets, or inaccurate information) arising out of the use, inability to use, or the results of the use of this Site, any websites linked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.

Communication, Use of Your Info

 

Communication Agreement

I grant permission to Symerge (non-profit organization housing Scor!) to periodically send me e-mails pertaining to Scor!. You may also occasionally receive emails from other Scor! faculty, collaborating publishers, or other connected and related parties concerning relevant similar opportunities. (We will not share or sell your data to unrelated data brokers or the like.)
 

Personal Information: When you provide us with personal information to become a participant in Scor! programs, you imply that you consent to our collecting it and using it for that program & future related programs. 

 

Scor! Video & Photo usage

The operators of Scor! (Symerge) may:

a. Record your participation and appearance on video tape, audio tape, film, or photograph, whether in-person or online (in videos & Zoom classes).

b. Use your name (limited to first name & last initial, or first & last initial), likeness, voice and biographical material (if provided) in connection with these recordings. If desired, you can opt out of any use of your name in connections with these recordings by sending a request in writing to [email protected].

c. Exhibit or distribute such recording in whole or in part without restrictions or limitation for any commercial, educational or promotional purpose which Scor! deems appropriate. Your image will not be used for immoral or unlawful purposes, for spreading hate or discrimination, or to defame or victimize other people, societies, or cultures.

d. Use comments, reviews, or surveys I have submitted for marketing purposes.

 

The Scor! Terms & Conditions, and all other policy pertaining to Scor! are construed under the laws of New York State and Monroe County, the location of Symerge (a.k.a. Scor!) headquarters.

These Terms & Conditions were revised Aug. 31, 2021 and remain in effect perpetually or until a new revision is made by Scor!.
